The de-annexation of public right-of-way is allowed pursuant to A.R.S. § 9-471.02 and § 9-471.03. Ordinance No. 5797 In 1990, 154+ acres of land were annexed into the City, including the land that is the subject of this proposed de-annexation ordinance. Since 1990, Maricopa County has determined that it needs an additional 10 feet of right-of-way in the area, specifically for Power Road.
